ISFED: Presidential Election by Illegitimate Parliament Declared Unconstitutional

The International Society for Fair Elections and Democracy (ISFED) states that any decision made by the illegitimate parliament, including the appointment of the presidential election date and the election of the president, is illegal and unconstitutional.

The organization states that the presidential election process was conducted in violation of the law.

"On November 25, at the first session of the Parliament convened by Georgian Dream, the powers of the members of Parliament were announced in such a way that the Mandate Commission did not wait for the Constitutional Court’s decision regarding the constitutional lawsuit filed by the President of Georgia and 30 members of Parliament, which challenged the constitutionality of the results of the October 26 elections for the Parliament of Georgia.

Under the Constitution of Georgia, Parliament acquires full powers only when the powers of two-thirds of its members are recognized. As per the regulations of the Parliament of Georgia, the name of any person whose election as a member of Parliament has been challenged in the Constitutional Court of Georgia should not be included in the resolution recognizing the authority of Parliament members. Since the legality of the election of all 150 members of Parliament was challenged by the constitutional lawsuit of the President of Georgia and members of Parliament, the new Parliament could not acquire powers until the Constitutional Court made a decision on this case.

Therefore, any decision made by the illegitimate Parliament, including the appointment of the presidential election date and the election of the president, is illegal and unconstitutional," said the statement issued by Fair Elections.

Today, December 14, the election of the sixth president of Georgia took place in the illegitimate parliament, where Georgian Dream elected Mikheil Kavelashvili to the position. He was the only presidential candidate nominated by the same party.

Based on the summary protocol of the Central Election Commission, 225 members of the 300-member electoral college participated in the election. Of these, 224 voted for Kavelashvili, and one ballot, cast by Ada Marshania, a member of the Supreme Council of the Republic of Abkhazia, was considered invalid.

The inauguration ceremony for Mikheil Kavelashvili as president is scheduled for December 29. Formally, starting from this day, the authority of the country’s fifth president, Salome Zourabichvili, will come to an end. However, she maintains that she remains the legitimate president and her "mandate continues until a legitimately elected parliament elects a legitimate president to replace her."
