"I signed the constitutional lawsuit. We, the deputies, are also filing a lawsuit in the Constitutional Court regarding these elections. At least formally, we want to go through all the legal procedures, so that later, when the investigation into the large-scale fraud and the rewriting of these elections takes place, and when we change the government, we will have a complete picture, including legal procedures," said Vashadze.
Today, November 19, President Salome Zourabichvili filed a lawsuit with the Constitutional Court. Due to violations of the constitutional principles of the secrecy and universality of the elections, the President is demanding the unconstitutional recognition of the controversial norms regulating the October 26 parliamentary elections and the final results of the elections held on their basis.
As the president's representative in court, Eka Beselia, stated, the violation of universality was evident in the fact that citizens abroad were "not only limited but also prohibited from enjoying their constitutional right."
"Thousands of citizens could not participate in the elections. This violates the constitutional right to universal suffrage. The second most important principle in the constitution is the protection of the secrecy of the vote in elections. There is substantial evidence that the secrecy of the vote was violated, which is a breach of the constitutional standard. We are disputing the constitutionality of the norms that require members of parliament to go through the procedure of recognizing their authority, even though their authority is not terminated at the same stage when the will is declared that they will not be in parliament, the results of which were falsified," Beselia said.
As per the law Of the Constitutional Court, the president, at least one-fifth of the members of parliament (30 deputies), and the public defender have the right to file a constitutional lawsuit regarding the constitutionality of the election norms and the elections held based on these norms.
It is not yet known when the regulatory session will be held or whether the court will accept the case. As constitutionalist Vakhushti Menabde explains, until there is a ruling from the Constitutional Court, the authority of the newly elected parliament cannot be determined.
