‘’When it comes to making a certain decision, despite the internal regulation of the National Bank being in place, priority is always given to the Constitution of Georgia. If such a decision was made by the National Bank, it goes strictly against the Constitution of Georgia, specifically, one of its basal principles, which is the presumption of innocence. Georgian citizens are specially protected by the Constitution of Georgia. Of course, a foreigner can be restricted from conducting commercial or other types of activities here, but when it comes to a citizen of Georgia, the state acts with heightened responsibility,’’ stated Kobakhidze, adding that it is difficult to react to the fact when the State Department does not publish evidence.
‘’When such heavy accusations are thrown around, they should of course be substantiated by concrete evidence. You will remember that in the case of the court when certain judges were subjected to visa restrictions, no solid evidence was released. The same is happening here, which severely hinders our ability to take action. It is necessary to provide evidence in such cases, it would be right by our state and Georgian society. When no evidence is provided, this raises concerns,’’ said Kobakhidze.
The leader of the ruling party responded to the statement of the President of Georgia, by which ‘’it’s the greatest tragedy when the prosecutor general of the country turns out to be an FSB agent’’
‘’First of all, the President of Georgia is required not to accuse a citizen of Georgia without evidence. Especially when it comes to accusing of a crime. This is the responsibility of the President of Georgia. She may not be a lawyer, but even citizenship candidates are required basic knowledge of the Constitution, let alone the President of Georgia. I would advise everyone, including the President, to acquaint themselves with the requirements of the constitution more,’’ said Kobakhidze.
On September 14, news broke that the USA imposed sanctions on the former chief prosecutor of Georgia, Otar Partskhaladze. The State Department document names Partskhaladze as a Georgian-Russian oligarch with whom Russia's Federal Security Service [FSB] worked to influence Georgian society and politics in Russia's favor.
Otar Partskhaladze served as the chief prosecutor of Georgia from November to December 2013.
